law. if a judge decides the state has hasn't adequately assisted in getting the identification, he can block the law from being imposed. the judge could leave the law in effect but let voters cast a provisional ballot. >>> jerry brown signed new legislation to let immigrants get driver's license. it covers immigrants who came to the u.s. before they were 16 and meet criteria to apply for a federal work permit program. >>> speaking of those young folks, when asked about the same workers, mitt romney said he would honor their temporary visas and allow the workers to say in the u.s. if he becomes president. this of course, is that executive order that the president signed. mitt romney had not said whether he was going to keep that order in place or rescind it. he says now, you can keep it in place. >>> one border patrol agent has been killed in a shooting near the mexico/arizona border. we're following that story. we'll get you more updates as we get them. >>> in today's deep dive, president

let me ask you about the law that the state party filed this complaint with the secretary of state. what is the legal requirement now by the secretary of state's office? what kind of -- does it get moved to criminal action or is this sort of a state ethics investigation? >> i think at this stage, chuck, it's probably a state ethics investigation. the secretary of state's office will certainly look into it, try to make a fair determination of what's really going on here. but i think bigger picture is what the legislature has done here in florida and other states as it relates to early voting and voter suppression if you will. that's really the big problem we're facing coming up on this presidential election in just 30 or so days and it's effecting not only early voting in the early voting hours, but it's also affected voting by mail. what i mean by that is the only way somebody can validate who they are when they vote by mail and send that ballot in is by the signature that they utilize and making sure that that signature they sign matches the one at the supervisor of election office

no question harvard business school versus harvard law school. no question that president obama showed his campaign has been doing the work for him and mitt romney has been doing the work for his campaign. we'll see what happens going forward. pout a question, the obama supporters were on their heels last night. were disappointed. wondering, where was this guy who they've been seeing in the tv commercials going so hard at mitt romney? he was clearly trying to be too presidential and not going after romney. >> we can't escape the fact. four of the last five incumbent presidents had lost the first debate. it's unbelievable. you have to say there is something to this. >> they're not used to being challenged in a way that he was for 90 minutes. you alone command the stage. his performance style reminded me of a press conference in the white house where he grips the podium. he does these long answers. john f. kennedy used to do 15 questions in 30 minutes. >> one of those. he's so used to be being on home turf. i don't think he took romney that serious

i think if a president could sign a law that said we will create more jobs that law would have been signed a long time ago. >> well i think he is looking at the fundamentals that are keeping people from hiring like the costs and taxes in obama care. like the over regulation that is stifling small business. like the constant talk of new taxes on small business. i think he is saying we're going to stop that. we're going to stop the over regulation. we're going to stop the taxes. we're going to get this economy jump-started. we're going to open markets in trade in central and south america where we have real opportunities. but on the tax reform, i think it is important that he is pretty bold in his specifics in saying he is going to limit upper income people's ability to get all the deductions. but he is not going to do it on the middle class. i think he has been specific and i think that's just been kind of glossed over. >> let me fill in some blanks here. he has said he is going to get rid of the estate tax though and he has said that he is not going to raise the rate on nonincome from -- o

it's law that just makes sense. >>> the 2009 nobel peace prize, the president said he viewed the prize as not of his accomplishments but as an acknowledgeable of an african leader. in making the case for why sometimes societies have to wage war. >>> anyway, despite the new pew poll about why voters gain traction nationally is that voter also make the race to 270. if you look at where the campaign made the most gains is among voters in the midwest. >> joining me now, roll call's david drucker listed only from the associated press. >> a week ago, there was a serious shift going on in ohio. new they're back. there's 49% and 47%. >> the path was there to begin with for romney. >> so narrowing it's hard to see how they do that. in ohio, it's a state that will be tight until the end. i'm not convinced it was ever a serious discussion, because the path is that narrow. so i think what withdryou're go see particularly in ohio, the race is going to be tighten, it will be a down to the wire race and the obama team recognizes that. and that's why you have seen the obama team continue to hammer on
